The question of the manner in which the Tannaitic and Amoraic literature was passed on, orally or in writing, is of great importance in determining the basic cultural and historical facts in the world of the Sages, in understanding the development of the Oral Law and in the formation of its literature. In Jacob Sussman's revolutionary study, this complex subject was re-examined based on a thorough and profound study of various Talmudic sources, while comparing them with external, time-based evidence, published for the first time in Talmud Studies in 2004. It is published again in this book, along with detailed indices for source texts and various topics discussed therein.

In the postmodern, relativist world-view with its refutation of a single, objective, and ultimate truth, it has become difficult if not impossible to argue in favour of one’s own beliefs as preferable to those of others. Miriam Feldmann Kaye’s pioneering study is one of the first English-language books to address Jewish theology from a postmodern perspective, probing the question of how Jewish theology has the potential to survive the postmodern onslaught that some see as heralding the collapse of religion. Basing her arguments on both philosophical and theological scholarship, Feldmann Kaye shows how postmodernism might actually be a resource for rejuvenating religion. Her response to the conception of theology and postmodernism as competing systems of thought is based on a close critical study of Rav Shagar (Shimon Gershon Rosenberg) and Tamar Ross. Rather than advocating postmodern ideas, she analyses their writings through the lens of the most radical of continental postmodern philosophers and cultural critics in order to offer a compelling theology compatible with that world-view. Whether the reader considers postmodernism to be inherently problematic or merely inconsequential, this study demonstrates why reconsidering these preconceptions is one of the most pressing issues in contemporary Jewish thought.

Every work on Jewish thought and law since the twelfth century bears the imprint of Maimonides. A. N. Whitehead’s famous dictum that the entire European philosophical tradition ‘consists of a series of footnotes to Plato’ could equally characterize Maimonides’ place in the Jewish tradition. The critical studies in this volume explore how Orthodox rabbis of different orientations—Shlomo Aviner, Naftali Zvi Yehudah Berlin (Netziv), Kalonymus Kalman Shapira, Joseph Kafih, Abraham Isaac Kook, Aaron Kotler, Joseph Soloveitchik, and Elhanan Wasserman—have read and provided footnotes to Maimonides in the long twentieth century. How well did they really understand Maimonides? And where do their arguments fit in the mainstream debates about him and his works? Each of the seven core chapters examines a particular approach. Some rabbis have tried to liberate themselves from the influence of his ideas. Others have sought to build on those ideas or expand them in ways which Maimonides himself did not pursue, and which he may well not have agreed with. Still others advance patently non-Maimonidean positions, while attributing them to none other than Maimonides. Above all, the essays published here demonstrate that his legacy remains vibrantly alive today.

This extraordinary commentary by an anonymous late twelfth-century northern French exegete interprets the Song of Songs solely according to its plain meaning as a story of two young lovers and their developing relationship. The exegete pays attention to every detail of the text, offering many enlightening insights into its meaning, all the while expanding upon the 'way of lovers' – the ways that young people in love go about their lovemaking. The French background of the exegete is made clear by many references to knights, coats of arms, weapons, chivalry, and of course, wine drinking, as well as numerous glosses in Old French. The edition is accompanied by an extensive introduction which analyzes the various exegetical, literary, and linguistic features of the text.

This study is the first monograph on the meanings given to the divine name YHWH in the Jewish tradition. It seeks to trace the interplay between the motivation to speak about God and the wish to speak to Him through the meanings given to the name YHWH, in three central stages of Jewish thought: the Hebrew Bible, rabbinic literature, and medieval philosophy and mysticism. From a textual perspective, the current study offers a close reading in a variety of Jewish texts and genres, including the Old Testament, Mishna, Midrash, Philo’s writings, Jewish medieval philosophy, biblical exegesis and various mystical texts . There is hardly an exegetical or contemplative Jewish text that does not in some way deal with the name YHWH. Accordingly, almost every scholarly field related to Judaism discusses it in some capacity. However, despite the immensity of the literature, YHWH and its status as a proper name have not been the focus of a comprehensive scholarly work. None have yet attempted to paint a picture of YHWH’s meaning over a spectrum of periods and genres, while offering conceptual and textual discussion. This study seeks to fill that gap.

The words seduction and ethics, which at first sight seem mutually exclusive, are at the heart of the analytic perspective. Vivian Chetrit-Vatine takes as her starting-point an encounter, which is not necessarily consensual, between Emmanuel Levinas's thought and his conception of philosophy as ethics - ethics understood as responsibility for the other - and that of the psychoanalyst Jean Laplanche, who posits the first adult other as a seducer of the young psyche from the outset, due to the transmission of enigmatic messages compromised by his or her unconscious. The analyst's ethical position is re-examined and with it the feminine/maternal origins of the human capacity for responsibility for the other.

In both these essays, "On the Indians" and "On The Laws of War", published here for the first time in Hebrew, Francisco de Vitoria lays down the foundations of international law as it is known today. De Vitoria develops for the first time concepts which will become the core of contemporary international law and international conventions, and in particular, participation in an unjust war, the ruler's personal responsibility for the decision about going to war, and the direct and indirect responsibility of subjects taking part in the hostilities. Both essays are firmly embedded in the debates of early modern Europe about the Law of Nature and the Law of Nations, and their impact on claims of European rulers to imperium and dominium (Imperial slugs and control) on overseas territories. In his wide-ranging Introduction to this book, Prof. Amos M egged places the two essays within the context and spectrum of the scholarly debates that were conducted at the major European universities during the early modern period, and provides the readers with a unique interpretation of the most distinctive themes in the essays, namely, the issue of human rights and international law, and presents personal insights on these aspects.

Il n’est pas étonnant qu’une des contributions de ce numéro s’intitule “Liberté, vitalité, spectacle” (Sophie Brunet). Dès lors, la division du volume s’est faite d’elle-même: 1-Un homme vivant; 2-Une oeuvre vivante. Au départ, le portrait d’un homme se dessine. Dans une “interview imaginaire.” On savoure son franc-parler, non que l’on adhère à toutes ses idées – en particulier en ce qui concerne Israël – mais on admire l’aisance et la liberté totale qui anime ses propos. Le comportement professionnel du cinéaste, son comportement tout court, trouvent leur place dans cette première partie. Parfois même, l’homme est saisi dans le feu de l’action. Les grands problèmes qui occupent le coeur et la pensée d’un homme de notre temps se retrouvent dans la seconde partie du volume. Là encore, au plus près de la vie . Le cinéaste interpelle les spectateurs lorsqu’il traite de la Shoah, de l’Occuption, ou de la Résistance, de la place que ces sujets tiennent dans la mémoire d’un Français ou d’un Allemand. On s’interroge avec le cinéaste : se doit-il d’être objectif? Mais “dès le début de sa carrière, remarque Pierre Beylot, un style documentaire original fondé sur la parole de témoignage et le montage des sources dont il assume de plus en plus ostensiblement le caractère subjectif” marque son oeuvre. C’est dire aussi que souvent le regard s’attarde sur le traitement esthétique des sujets abordés. Ecoutons François Niney:“Cette remise en question de nos manières de voir et de nos dilemmes, à la fois politiques et personnels, par le jeu et le poids des mots, différencie radicalement le documentaire selon Marcel, du panel d’opinions tel que l’expose en permanence l’étal médiatique”. L’important est que son public réfléchisse. Il s’agit, selon Valérie Carré, de “mettre en mouvement la réflexion du spectateur”. Qu’attendre de l’avenir? Encore une oeuvre surprenante? Vincent Lowy, à l’écoute, note: “Boulimique de projets virtuels, l’infatigable MO junior annonce déjà les quatre titres d’ […] improbables best-sellers…” [futurs romans policiers }.
