Fundamental Rights and Public Policy in the Supreme Court

This monograph originated in the Paley Lectures in American Civilization, at the Hebrew University of Jerusalem, May 1978.

The lectures tackle one of the most powerful forces shaping American constitutional law, a notion deeply rooted in the county’s pre-constitutional history: the idea that there are natural, or fundamental, rights which take precedence over the enactments of legislatures.
